John and Shanneal Herron have launched a claim for more than £100,000 in damages from Alexander Wotherspoon who ran over the 17-year-old in September last year.

Tragedy struck soon after the popular teenager had enjoyed a meal at the nearby Linwood Farm with her gran.

Horrified onlookers said the gentleman reversed his silver Ford Focus estate in a panic and hit the Paisley youngster, as well as her blue Renault Clio car, before dragging her across the forecourt into bushes.

Emergency services attended the Asda garage at around 2.30pm on Wednesday, September 10, 2014, but it’s understood Eilish died at the scene as a result of her injuries.

In the wake of the heartbreaking news, mum Shanneal, 46, described it as a “freak accident” and said she did not blame the driver.

However law firm Digby Brown, based in Glasgow, this week confirmed the Herron family are now pursuing a compensation claim against the OAP.

Papers lodged at the Court of Session in Edinburgh this month are said to accuse Mr Wotherspoon of negligence when he hit new driver Eilish with his Ford Focus.

Eilish, a promising netball player, had been due to celebrate her 18th birthday just a few weeks after she was killed.

She was also awarded Renfrewshire’s Young Sportsperson of the Year in 2013, went to St Andrew’s Academy in Paisley and was due to start a nursing degree.

In the wake of her death, hundreds of tributes poured in for talented Eilish, whose passing shook large segments of the local community.

But the most tear-jerking tribute was that of her parents, Shanneal, and John, 44, who said the accident had left them and Eilish’s younger siblings, Niall, 15, and Neave, 12 devastated.

Shanneal told The Gazette: “Eilish was such a lovely girl. She was always so caring and never gave us a moment’s trouble her whole life.

“She would have been 18 next month and we’d been planning for her birthday. We wanted to do something special for her.

“We have such a large family, and we have all been left completely devastated by this.” A spokesman for Digby Brown said: “We are representing the pursuer in a civil court action.”
