A JOHNSTONE man who was placed on the Sex Offenders’ Register after being convicted of bedding an underage girl will have to wait to learn his fate, due to a paperwork blunder.

Kyle Cummings, 22, sobbed in the dock at Paisley Sheriff Court earlier this year as he was warned he faces jail for having sex with the 15-year-old schoolgirl.

The youngster, who wore her school uniform while giving evidence, said she was groomed by Cummings after meeting him through his job at a fairground.

She said he got her mobile phone number after meeting her at the fair and then began to go on trips with her.

The girl started travelling from her home in Inverclyde to Cummings’ home in Johnstone’s Cartside Avenue to spend evenings with him.

And during a visit there on October 27 last year, two days after she told him she was sitting through an English lesson at school, she said they had sex.

Cummings was found guilty of having sex with her while she was over the age of 13 but under the age of 16, in breach of Section 28 of the Sexual Offences (Scotland) Act 2009.

He did not give evidence in the case and claimed through his solicitor that he hadn’t known the girl was only 15.

Sentence was deferred for background reports and Cummings returned to the dock yesterday to be sentenced but his case could not be dealt with because of a social work blunder.

Defence solicitor Gordon Ritchie said: “Unfortunately, we are without a report. Somewhere between the clerks office and the social work office, someone was of the opinion that someone ordered a Pathways report.”

A Pathways report is a specialist report from social workers that deal with sex offenders in Renfrewshire.

Sheriff Susan Sinclair said she only needed a normal social work report and deferred sentence until later this month.
